Legal Literacy - The legal teams of presidential and vice-presidential candidates Anies Baswedan-Muhaimin Iskandar and Ganjar Pranowo-Mahfud MD are preparing to file petitions for election result disputes president after the General Election Commission stipulated the results of the 2024 Election.
Meanwhile, the legal team of the Prabowo Subianto-Gibran Rakabuming Raka pair is ready to face the lawsuit by becoming a related party. They claim it is difficult for the petitioners to prove fraud in the presidential election due to the very large difference in votes.
To date, the General Election Commission (KPU) still has until March 20, 2024, to complete the recapitulation of the national vote count. As of Tuesday (19/3/2024) afternoon, the KPU has recapitulated the results of the national-level vote count from 34 provinces and 128 Overseas Election Committees (PPLN). Recapitulation is still continuing for four provinces that have not yet recapitulated votes, namely West Java, Maluku, Papua, and Highland Papua.
The Head of the National Legal Team for candidate pair number 1, Anies Baswedan-Muhaimin Iskandar, Ari Yusuf Amir, explained that the process of drafting the lawsuit petition to Constitutional Court (MK) has been carried out since last month. The legal team has collected facts and evidence of alleged fraud in the 2024 Presidential Election. The manuscript has been completed with the theme of Betrayal of the Constitution.
According to Ari, the alleged fraud includes directing or impartiality of state apparatus organizers before voting, as well as the use of state funds in social assistance programs to win certain candidate pairs. Alleged fraud also occurred during voting until the vote counting process.
Todung Mulya Lubis, Deputy of Law of the Ganjar Pranowo-Mahfud MD National Winning Team, added that the lawsuit file accompanied by evidence of alleged structured, systematic, and massive election fraud is ready. They will file a lawsuit for election result disputes to the Constitutional Court after the KPU stipulates the results of the national vote recapitulation.
Meanwhile, Hinca LP Pandjaitan, Commander of Legal Echo and Advocacy for the Prabowo-Gibran National Campaign Team, revealed that preparations for facing the presidential election result lawsuit at the Constitutional Court had been made long in advance. They have prepared 30 advocates and claim that it is difficult for the petitioner to prove fraud in the presidential election because the difference in votes is very large.
