Legal Literacy - In general, we only know two types of lawsuits in Indonesian civil procedure law, namely Breach of Contract Lawsuits and Unlawful Act Lawsuits (PMH). Both are filed through the District Court. However, if examined more deeply, it turns out that there are other types of lawsuits outside of these two types. This lawsuit has different characteristics from what we usually know. Among them are Lawsuit Class Action and Lawsuit Citizen Lawsuit.
This term may sound a bit foreign to the ear. However, in practice, there have been many filings of cases related to Class Action or Citizen Lawsuit, even some of them have been won by the court.
This article will focus on Lawsuit Citizen Lawsuit. This is a legal corridor for citizens who feel their rights have been violated to sue the state (through state administrators/officials/agencies) to fulfill their legal obligations. This demand usually takes the form of administrative steps, such as:
-
Improving policies;
-
Stopping violations; or
-
Guaranteeing public rights.
Because it demands the fulfillment of state administrative obligations due to Unlawful Acts by the Government (PMH-P), this is the main differentiator with Class Action. Class Action more emphasis on claims for direct compensation to a group of people who have suffered losses.
