Jakarta, Legal Literacy - Jokowi successfully won the lawsuit case in the State Administrative Court (PTUN), with Otto Hasibuan, his lawyer, stating that the allegations of dynasty politics were unproven. This lawsuit was initially filed by the Nusantara Advocate Association (Perekat Nusantara) and the Indonesian Democracy Defense Team (TPDI).
The State Administrative Court rejected the lawsuit on the grounds that the individuals being sued, including Jokowi, Iriana Jokowi, Gibran Rakabuming Raka, Anwar Usman, and others, could not be processed because PTUN it only has the authority to adjudicate individuals holding official positions.
Otto explained that there were two main reasons for the rejection of the lawsuit. First, the petitioners sued these individuals in their personal capacity, while the State Administrative Court only has the authority to adjudicate them in their official capacity. Second, the petitioners were required to pursue other administrative efforts before bringing the case to the State Administrative Court.
According to Otto, the lawsuit was actually not appropriate to be filed with the State Administrative Court and appeared more as a political effort. He also asserted that the lawsuit was a step to tarnish Jokowi's reputation with allegations of dynasty politics, but the State Administrative Court's decision proved otherwise.
Otto assessed that TPDI and Perekat Nusantara used the court as a political strategy to achieve their goals. Petrus Selestinus, Coordinator of TPDI and Perekat Nusantara, explained that the lawsuit highlighted the involvement of Jokowi's family, including Anwar Usman and Gibran Rakabuming Raka, in dynasty politics.
Nevertheless, Otto expressed doubts about the impartiality of the Jakarta State Administrative Court in adjudicating this case and announced plans to refile a lawsuit related to dynasty politics and nepotism.
