JAKARTA, LEGAL LITERACY - The Constitutional Court (MK) on Monday (29/4/2024) morning, held a Preliminary Hearing for the General Election Results Dispute (PHPU) for the election of members of the Intan Jaya Regency DPRD, Intan Jaya Electoral District 3. This case, with number 163-02-03-36/PHPU.DPR-DPRD-XXII/2024, was filed by Demianus Mazau, candidate for member of the Intan Jaya Regency DPRD from the Indonesian Democratic Party of Struggle (PDI-P) number 1.

The Preliminary Hearing, led by Constitutional Justice Arief Hidayat, together with Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih, discussed the petitioner's claim that through his attorney, Regio Alfala Rayandra, argued that there was a significant difference in the acquisition of votes. "Demianus Mazau should have obtained 3,879 votes, but the respondent nullified them," said Regio.

The petitioner suspects that there was a transfer of votes by individuals from the District Election Committee (PPD) and the Regional General Election Commission (KPUD) of Intan Jaya Regency without the knowledge of the public or the candidate concerned. The election implementation process did not reflect the principles of direct, general, free, and secret (luber jurdil) in accordance with statutory regulations.

According to the petitioner, there was also a loss of election logistics in the form of forms required for voting and vote recapitulation at almost all Polling Stations (TPS) in eight districts. The petitioner also revealed that the chaos due to the unavailability of Form C. Results at each TPS resulted in confusion regarding the acquisition of votes for each candidate, so that the tiered recapitulation was also problematic.

Demianus Mazau, represented by his attorney, also stated that the Intan Jaya Regency Election Supervisory Body (Bawaslu) recommended the cancellation of the results of the plenary vote recapitulation for Intan Jaya Regency. However, this recommendation was not followed up by the KPU.

"Due to these various problems, the Intan Jaya Regency Bawaslu issued a recommendation. However, it was not followed up by the organizers," said Regio Alfala Rayandra.

Based on these allegations, Demianus Mazau asked the Constitutional Court to grant his petition in its entirety, cancel KPU Decree Number 360 of 2024, and determine the correct vote acquisition results for him, namely 3,879 votes, so that he would rank first in the valid votes for candidates for members of the Intan Jaya Regency DPRD in the Intan Jaya 3 electoral district from PDI-P.
