JAKARTA, LEGAL LITERACY - The Constitutional Court of the Republic of Indonesia (MK) held a preliminary hearing for the Dispute over General Election Results (PHPU) case for prospective members of the DPRD of the Deyai 3 Electoral District (Dapil) today, Monday, April 29, 2024. The case with number 106-02-01-36/PHPU.DPR-DPRD-XXII/2024 was filed by Agusten Yuppy, a candidate for DPRD of Deyai Regency, Electoral District 3 of National Awakening Party (PKB), who argued that there was alleged vote manipulation by the Deyai Regency KPU.
Alleged Changes to PKB Vote Results in Deyai Regency
The preliminary hearing was presided over by Constitutional Justice Arief Hidayat, with member justices Anwar Usman and Enny Nurbaningsih. In his petition, the Applicant, represented by his attorney, Subani, argued that the Deyai Regency KPU allegedly changed the PKB vote acquisition results so that C. Hasil Plano and D. Hasil were not in accordance with the recommendations from the Regency Bawaslu, which did not coordinate with the Kapiraya District PPK.
The Applicant claims that the correct PKB vote acquisition based on C. Hasil Plano and D. Hasil of Deyai Regency 3 is 2,034 votes.
The Applicant's Objections Were Not Addressed by the KPU
The Applicant, through his attorney, revealed that when conducting the vote recapitulation meeting at the Deyai Regency KPU, his team had officially submitted a protest or objection and requested the use of the Noken vote counting system that had been agreed upon. However, the Deyai KPU ignored the objection.
Applicant's Demands
The Applicant requests the Court to grant his petition in its entirety, to annul the Decree of the General Election Commission Number 360 of 2024, and to determine the correct vote acquisition results according to the Applicant for filling the membership of the DPRD of Deyai Regency, Electoral District (Dapil) 3, which is 2,034 votes.
