Legal Literacy - Criminals of Passion or Crimes of Passion in Indonesian, refers to violent crimes, especially murder, where the perpetrator commits the act against someone due to a sudden strong impulse such as anger or jealousy, rather than as a pre-planned crime.

This term is often used in popular culture to describe crimes driven by uncontrolled romantic love, but the reality is often more complex.

Crime in the Perspective of Criminal Law and Criminology

Since ancient times, crime has been a serious phenomenon and problem in people's lives. Some examples of crimes such as persecution, theft, and even murder have existed since ancient times until the modern era.

According to the Indonesian Dictionary (KBBI), crime is human behavior that contradicts written laws ratified/enforced by the State as well as values and norms that apply in society. Some criminologists essentially define crime as human behavior that is considered to violate norms in society, causing harm and even causing victims. Sociologist Thorsten Sellin even defines crime as a violation of conduct norm (norms of conduct) which sometimes do not have to be contained in law.

The experts criminal law also have their own thoughts regarding the definition of crime which is not much different from the opinions of criminologists. Like R. Soesilo defines crime from a juridical point of view as an act of human behavior that contradicts written laws such as the Law, and from a sociological point of view crime is an act of human behavior that harms the victim as the suffering party and often results in the loss of peace in society.

Criminals of Passion

As stated at the beginning, criminology can be used to find out the reasons why someone commits a crime. In a biological perspective, criminology divides or classifies perpetrators crime in 4 (four) types of groups, namely Born Criminal, Insane Criminal, Occasional Criminaland Criminals of Passion.

Based on several references in books and scientific journals, the definition of criminals of passion is broadly defined as perpetrators of crimes or criminal acts who commit crimes or criminal acts due to anger or love. This condition ultimately shuts down the perpetrator's reasoning and results in the loss of the ability to distinguish between right and wrong.

An example case that can be viewed from the perspective of criminals of passion and attracted considerable public attention is the case of serial murders committed by Very Idham Henyansah alias Ryan Jombang. This case occurred in 2008 and was widely covered by mass media, both print and electronic.

At that time, it was known that the motive for the murder committed by Ryan against his victim was jealousy within the framework of a homosexual relationship. The Depok District Court then sentenced Ryan to death in 2009.

Another case occurred in East Jakarta. This murder was quite sadistic and involved more than one perpetrator.

A woman with the initials T and a man with the initials BS jointly committed the murder of a female victim with the initials DAS. This criminal event occurred around 2013.

Initially, T and BS worked together to establish and run a soto restaurant business located in BS's rented house. Subsequently, T and BS met and became acquainted with the victim DAS, who eventually helped manage and run the soto restaurant business.

Initially, T, BS, and the victim DAS had a good relationship, marked by the three of them alternately and jointly operating a 24-hour soto restaurant. BS, T, and the victim-witness DAS essentially had a close relationship, even resembling that of a married couple.

The problem began when BS suspected the victim DAS of committing adultery. BS often found DAS going out with other men, but DAS refused to reveal the identity of the men. Driven by jealousy, BS then committed violence against the victim DAS, which resulted in the loss of life.

BS, assisted by T, committed a series of violent crimes that resulted in the death of the victim DAS. The acts of violence began with continuous beatings using wood to the head and kicking the ribs of the victim DAS.

After ensuring that the victim DAS was no longer breathing, the sadism of T and BS did not stop. The two perpetrators then mutilated the limbs of the victim DAS and put them in a plastic bag. The plastic bag containing the body parts of the victim DAS was then disposed of by T and BS on the Jakarta-Cikampek Toll Road, East Jakarta.

BS was eventually sentenced to 14 years in prison by the East Jakarta District Court. As for T, based on the Decision of the Jakarta High Court Number: 380/PID/2013/PT.DKI dated December 12, 2013, jo. The Decision of the East Jakarta District Court Number: 558/Pid/B/2013/PN.Jkt.Tim dated September 26, 2013, also sentenced him to 14 years in prison because he was proven to have intentionally assisted in committing premeditated murder.
