JAKARTA, LEGAL LITERACY - The Constitutional Court of the Republic of Indonesia held a preliminary hearing on the dispute over the results of the General Election for Members of the Intan Jaya Regency DPRD, Central Papua Province, on Monday (29/4/2024) Morning. This case is registered under case number 68-02-02-36/PHPU.DPR-DPRD-XXII/2024, was filed by Oktovianus Wandikmbo, candidate for member of the Intan Jaya Regency DPRD, serial number 1 from the Great Indonesia Movement Party (Gerindra), Intan Jaya Electoral District 3.
Alleged Vote Elimination
The preliminary hearing, led by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih, discussed alleged fraud in the vote acquisition. The petitioner, represented by his attorney, Salhan Adiputra Alboneh, argued for the elimination of votes from four villages totaling 4,772 votes. The petitioner suspects that the votes were stolen and/or eliminated by members of the District Election Committee (PPD) and the Voting Committee (PPS), which were then transferred to other candidates.
According to the petitioner, the votes that should have been obtained were 5,049, but the respondent's version (General Election Commission) recorded only 277 votes for the petitioner. Meanwhile, the votes obtained by the Legislative Candidate from the Gerindra Party, serial number 2, Salmon Nagapa, should have been only 259, compared to the recorded 5,031.
“There is a difference of 4,772 votes between the petitioner and Salmon Nagapa. Salmon should have only obtained 259 votes,” said Salhan Adiputra Alboneh.
In addition to the difference in votes, the petitioner revealed a recommendation from the Intan Jaya Regency Election Supervisory Body (Bawaslu) Number: 083/Rekom.01.0/K.PT/08/III/2024 dated March 05, 2024, regarding the Cancellation of the Plenary Vote Recapitulation Results for Intan Jaya Regency. However, the recommendation was not followed up by the election organizers.
Petition of Oktovianus Wandikmbo
Based on this issue, Oktovianus Wandikmbo, through his attorney, requested the Court to grant his petition in its entirety, annul the General Election Commission Decree Number 360 of 2024, and determine the correct vote acquisition results according to the Petitioner.
