JAKARTA, LEGAL LITERACY – Former members of the PPK of Ranto Peureulak District to the Head of the PPS of Buket Pala Village, Ranto Peureulak District, confirmed that there was an inflation of votes for PAS legislative candidate, Muhammad Daud. This statement was made in the follow-up hearing of the General Election Results Dispute (PHPU) in Panel 3 Courtroom, Building 1 of the Constitutional Court (MK) on Wednesday (29/05/2024). The trial was led by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih. The case registered with number 121-02-22-01/PHPU.DPR-DPRD-XXII/2024 was filed by Subki Tgk. Jek, a candidate for DPRK member for the East Aceh Electoral District (Dapil) 2 from the Adil Sejahtera Party (PAS Aceh).
In the trial, M. Akbar Rafsanzani, the Petitioner's witness who was a former member of the PPK of Ranto Peureulak District, explained that there was an inflation of votes for legislative candidates in the name of Muhammad Daud, number 5 from the PAS party from 901 votes to 963 votes. Furthermore, Akbar also explained that he did not sign the Minutes because it was clear that there was an inflation of votes.
“It is true that there was an inflation of votes for PAS Party number 5, Muhammad Daud from 901 votes to 963 votes. I did not sign the Minutes at the DPRK level because it was clear that there was an inflation of votes,” said Akbar.
However, in the trial attended by Akbar online, he could not explain where the additional votes came from, because Akbar said that there was no reduction for other candidates in the sub-district. “There is no reduction,” he said. Akbar also did not know the process of inflating the votes.
Akbar added that there were differences in the C-Results and D-Results. In the C-Results, Caleg Daud's votes were 901 votes, but in the D-Results it became 963 votes. “C-Result 901 votes, D-Result 963 votes. There is a difference, Your Honor,” he said.
In addition to Akbar, the Petitioner also presented Saipul Anwar as a witness who during the Election was a Mandate Witness in East Perlak District from the PAS Party. Anwar explained that there was an inflation of votes in East Perlak District for legislative candidate number 5 from the PAS Party in the name of Muhammad Daud from 23 votes to 238 votes. Furthermore, Anwar explained that there was a difference between the C-Result and the D-Result. In the C-Result, Daud's votes were 23 votes, while in the D-Result it changed to 238 votes. “There was an inflation of votes in East Perlak District for legislative candidate number 5 from the PAS party in the name of Muhammad Daud from 23 to 238 votes. C-Result 23 votes, D-Result 238 votes,” said Anwar.
The Petitioner also presented Surya Darma as a witness who was the Head of the PPS in Buket Pala Village, Ranto Peureulak District. Surya explained that there were no errors in each C-Result because if there were any errors or mistakes, they would be corrected directly according to the facts on the ground. However, the error occurred in the D-Result. According to Surya, in Ranto Peureulak District, based on the C-Result, Muhammad Daud obtained 901 votes, but when in the D-Result it changed to 963 votes. Meanwhile, Subki Tgk's votes. Jek did not change. “The error did not occur in the C-Result, because if there was an error in the C-Result, it would definitely be corrected immediately according to the facts on the ground. The error occurred in the D-Result. Muhammad Daud's votes in Ranto Peureulak District were 901 based on the C-Result. Meanwhile, based on the D-Result, there were 963 votes,” said Surya.
Finally, the Petitioner presented Taufik Hidayat as a witness who explained that the Petitioner's dispute with Muhammad Daud occurred because of an inflation of votes. The Petitioner had previously asked for it to be resolved in the Party Court, but Muhammad Daud did not attend two levels. In the end, the Petitioner asked the MPP for this dispute to be resolved in the Constitutional Court. “Subki Tgk. Jek initially asked for it to be resolved in the Party Court, but Muhammad Daud was absent twice, so Subki Tgk. Jek asked the MPP for it to be resolved in the Constitutional Court,” said Taufik.
Meanwhile, Marwan, a witness from the KPU, said that there were no objections at all to the election of DPRK candidates in East Aceh 2. “There are no objections,” said Marwan. The same thing was also conveyed by another KPU witness, Khairul Rizal.
According to the KPU through its witness, Said Ramadhan, explained that in Ranto Peureulak District, Subki Tgk. Jek, the petitioner, in the D-Result was recorded as obtaining 47 votes, while Muhammad Daud obtained 963 votes. “Subki Tgk. Jek 47 votes, Muhammad Daud 963 votes,” he said.
In Ranto Peureulak District, according to the C-Result, Subki Tgk. Jek obtained 51 votes, while Muhammad Daud obtained 901 votes. Meanwhile, in the D-Result, Subki Tgk. Jek became 47 votes, Muhammad Daud 963 votes. “Subki Tgk. Jek 51 votes, Muhammad Daud 901 votes. In the D-Result, Subki Tgk. Jek 47 votes, Muhammad 963 votes,” he said.
Previously, in the petition, the Petitioner argued that there was a difference in the vote acquisition which according to the Petitioner was correct with that stipulated by the Respondent (General Election Commission). Based on a comparison of Form Model C. Results - DPRK and Form Model D. Results of the DPRK District from two sub-districts in Dapil 2, namely East Peureulak and Ranto Peureulak, there was a difference in votes or an inflation of votes that benefited the Adil Sejahtera Party Legislative Candidate number 5 in the name of Muhammad Daud by 77 votes. This increase in votes caused Legislative Candidate number 1 (Petitioner) to lose a seat in the East Aceh DPRK.
Based on the arguments presented, the Petitioner asked the Constitutional Court to grant the Petitioner's entire petition, annul the General Election Commission's Decision number 360 of 2024, and order the General Election Commission to carry out a recount of ballot papers in East Peureulak District and Ranto Peureulak District in the East Aceh 2 Electoral District or determine the correct vote acquisition results according to the Petitioner for filling membership of the Aceh Timur Regency DPRK in the East Aceh 2 Electoral District.
