Legal News – Dirty Vote is an explanatory documentary film about the 2024 elections fraud. The film, which lasts 1 hour, 57 minutes, and 21 seconds, premiered on Sunday (11/2/2024) at 11:11 AM via the Dirty Vote Youtube channel.
This documentary features three constitutional law experts' views, namely Bivitri Susanti, Feri Amsari, and Zainal Arifin Mochtar regarding the fraud that occurred in the 2024 presidential and vice-presidential elections.
At the opening of the film, Bivitri revealed that this year's election cannot be considered normal.
“I want to be involved in this film because many people will understand even more that extraordinary fraud has indeed occurred, so this election cannot be considered normal,” explained Bivitri.
In general, there were various frauds that occurred in the 2024 elections, including the provision of social assistance, the use of regional head authority, and fraud within the KPU.
This article contains a description of the arguments from each constitutional law expert regarding the fraud of the 2024 elections as presented in the Dirty Vote documentary film.
Dirty Vote in Feri Amsari's Perspective
Through the film, Feri Amsari first gave a response regarding the “one round” narrative echoed by the Prabowo-Gibran candidate pair in the 2024 elections. According to him, this is not that easy to do. Moreover, one round must meet the requirements stated in Article 6A paragraph (3) of the 1945 Constitution, namely:
"The presidential and vice-presidential candidate pair who receive more than fifty percent of the votes in the general election with at least twenty percent of the votes in each province spread across more than half the number of provinces in Indonesia, are inaugurated as President and Vice President."
Furthermore, Feri Amsari showed the 2009 Presidential Election Victory Distribution Data which illustrates how many and vast the victory areas of President Susilo Bambang Yudhoyono (SBY) were. Meanwhile, the CSIS Sumatra Survey 13-18 December 2023 stated that the Prabowo-Gibran pair only dominated one-third of the Sumatra Province area. Therefore, according to him, it is not easy for presidential and vice-presidential candidates to win 50% of the vote in one round.
On the other hand, Feri not only discussed in which areas a presidential and vice-presidential candidate received the most support, but also who the leader of the area was. Considering that the neutrality of regional officials can also be a factor in the number of votes for a presidential and vice-presidential candidate.
In this case, he gave an example of a phenomenon that occurred in Sorong, West Papua, where the regent, Yan Piet Moso, signed an Integrity Pact with the Regional Intelligence Agency which contained an agreement to be ready to seek support and contribute a minimum of 60% + 1 votes to Ganjar Pranowo in the 2024 elections. According to him, this figure is considered serious.
Dirty Vote in Zainal Arifin Mochtar's Perspective
Continuing the explanation from Feri Amsari, Zainal Arifin argued that abuse of regional head authority is an important factor in winning elections, especially in terms of regional distribution.
In this case, Zainal also explained 3 authorities of regional heads that can trigger fraud in elections, namely:
- Mobilizing the bureaucracy
- Campaign location permits
- Imposing sanctions or allowing village heads who are not neutral.
At the same time, he also showed an example that there were 6 Anies campaigns whose permits were revoked by the regional government and there was an activity at GBK involving the Desa Bersatu organization where they declared support for the Prabowo-Gibran candidate pair. Even though, in the end, Bawaslu DKI stated that the Desa Bersatu action had violated the original concept, which was limited to national friendship.
Responding to this, Zainal also explained that there are 4 authorities of village heads that can trigger fraud and be misused during elections, namely:
- Voter data
- Use of village funds
- Data on recipients of social assistance, PKH, BLT
- Authority to allocate Social Assistance.
Ironically, apart from having the authority that has the potential to be used in fraud, there is an example of a problem that comes from village heads in the Central Java region. He admitted that he often received pressure from various parties to win certain candidates. This was accompanied by the sudden provision of social assistance that did not match village poverty data.
Dirty Vote in Bivitri Susanti's Perspective
After discussing the fraud that occurred at the lower level, Bivitri Susanti in the film Dirty Vote began to reveal various frauds that occurred among state officials. Still related to social assistance, Bivitri presented data showing the allocation of funds for social assistance from 2014-2024. The data shows that the provision of social assistance soared in every election year.
Not only that, the government also issued other populist policies, such as an 8% increase in the salaries of civil servants, the TNI (Indonesian National Armed Forces), the Police, and PPPK (Government Employees with Work Agreements), as well as a 12% increase in the pensions of retired civil servants.
This raises the question of whether these policies aim to improve welfare or are merely populism. Because it turns out that workers' wages only received an increase of 3.2-4.4%.
On that occasion, Bivitri also invited the public to remember the welfare of the people and the essence of providing social assistance.
"Social assistance or bansos is not political or official assistance. Social assistance is actually a way to quickly implement the mandate of the 5th principle of Pancasila regarding social justice," explained Bivitri.
Then, she also emphasized that social assistance is an implementation of Article 34 of the 1945 Constitution of the Republic of Indonesia, which reads:
"The Poor and Abandoned Children shall be cared for by the State"
However, in reality, social assistance is still often used as a tool for political purposes. Through the film Dirty Vote, Bivitri explains one of the concepts in political science called "Pork Barrel". The term refers to the era of slavery in the United States, which made slaves have to fight over preserved pigs in barrels.
The concept means that "Pork Barrel" is a way of doing politics that uses state money to be channeled into electoral districts by politicians so that they can be re-elected.
Dirty Vote in the Perspective of Three Constitutional Law Experts
After revealing in detail the issues related to social assistance and abuse of authority by regional heads, three experts constitutional law also discussed the peak of the 2024 election fraud, namely the problems that occurred in the Constitutional Court.
Starting from the PSI (Indonesian Solidarity Party) which initially nominated Gibran as president, on March 9, 2023, submitted a request for judicial review of the Election Law Article 169 letter q which regulates the age limit for presidential and vice-presidential candidates which was originally 40 years to 35 years.
In this case, Feri Amsari emphasized to the public to remember that the chairman of the Constitutional Court (MK) is Gibran's uncle himself.
The next polemic discussed in the film Dirty Vote is about the Constitutional Court's decision number 90/PUU-XXI/2023 which turned out to have passed Gibran, who is currently 36 years old, as a 2024 vice-presidential candidate with Prabowo Subianto.
As a closing of the film Dirty Vote, the three constitutional law experts gave closing statement related to the 2024 election fraud.
"All of these plans were not designed overnight, nor were they designed alone. Most of the structured, systematic, and massive fraud plans to outsmart this election were actually drawn up together with other parties. They are the forces that have been in power together for the last 10 years," said Feri Amsari.
"Political competition and the struggle for power, the fraud design that has been prepared together, finally falls into the hands of one party, namely the party that is holding the key to power where it can move the apparatus and the budget," continued Zainal Arifin.
"But actually this is not a great design or plan. Scenarios like this have been carried out by previous regimes in many countries and throughout history. Therefore, to compile and run a dirty scenario like this, you don't need cleverness or intelligence, all you need is two things: a cunning mentality and being shameless," concluded Bivitri.
To date, exactly 13 hours after the documentary was uploaded, the film Dirty Vote has been watched by more than 2 million people and the number of comments has reached almost 17,000 people.
